Diddy Arrest: Unsealed Indictment Reveals Sex Trafficking and Racketeering Charges

Following Diddy’s arrest in New York, the indictment that led to the Bad Boy Records founder being taken into custody by federal agents has been unsealed.

This move was not a surprise, as Damian Williams, U.S. Attorney for the Southern District of New York, said shortly after Diddy’s arrest on Monday that a then-sealed indictment would be further detailed in the coming hours.

“Earlier this evening, federal agents arrested Sean Combs, based on a sealed indictment filed by the SDNY,” Williams said Monday night. “We expect to move to unseal the indictment in the morning and will have more to say at that time.”

Per an initial report from the Associated Press, the unsealed indictment reveals sex trafficking and racketeering charges. Marc Agnifilo, an attorney for Diddy, told reporters earlier on Tuesday that these charges were expected. Diddy is also alleged to have engaged in transportation to engage in prostitution, per a separate report from NBC News.

The 14-page indictment, available here, accuses Diddy of having “abused, threatened, and coerced women and others around him to fulfill his sexual desires, protect his reputation, and conceal his conduct.” This is alleged to have led to the creation of what prosecutors are calling “a criminal enterprise.”

The sixth page of the NBC-provided doc details allegations of so-called “Freak Offs,” namely that “members and associates of the Combs Enterprise” are accused of helping facilitate such activity by booking hotel rooms and then stocking them with “the required Freak Off supplies.” Listed supplies alleged to have been involved in this process include controlled substances, baby oil, lubricant, extra linens, and lighting. Additionally, previously reported searches of Diddy’s properties earlier this year are alleged to have resulted in the seizure of “various Freak Off supplies,” including drugs and over 1,000 bottles of baby oil and lubricant.

Agnifilo previously issued a statement on Monday and criticized the larger case as an “unjust prosecution” of his client.

“He is an imperfect person, but he is not a criminal,” Agnifilo said, in part, in a statement shared with Complex. “To his credit, Mr. Combs has been nothing but cooperative with this investigation and he voluntarily relocated to New York last week in anticipation of these charges. Please reserve your judgment until you have all the facts. These are the acts of an innocent man with nothing to hide, and he looks forward to clearing his name in court.”

Agnifilo also spoke with reporters outside a Manhattan courthouse early Tuesday, saying his client was "not guilty" of the charges against him.

This all follows multiple allegations and lawsuits against Diddy over the past year, as well as the release of hotel surveillance footage from 2016 showing him kicking and dragging Cassie, with whom he was in a romantic relationship at the time. In late 2023, Cassie accused Diddy of rape and abuse in a lawsuit that was ultimately settled.

While Diddy has adamantly denied other allegations against him, he later issued an apology in response to the Cassie footage, saying he was “disgusted” by his behavior.

“My behavior on that video is inexcusable,” he said in May. “I take full responsibility for my actions in that video.”
