Diddy Michigan Inmate Lawsuit: Judge Sets Aside $100 Million Default Settlement

Diddy filed a motion to throw out the $100 million default settlement the week before his arrest on sex trafficking and racketeering charges.

Diddy won't have to pay the $100 million default settlement in a lawsuit filed against him by an inmate in Michigan.

Per TMZ, the judge in the lawsuit filed by inmate Derrick Lee Cardello-Smith has agreed to throw out the $100 million default settlement after Diddy initially failed to respond to the sexual assault lawsuit. The Bad Boy Records founder's attorney David Fink was able to convince the judge on the case, Judge Anna Marie Anzalone, to reevaluate the case, which accused Diddy of drugging and sexually assaulting Lee Cardello-Smith at a party in Detroit in 1997.

The judge also removed the temporary restraining order that would have prevented Diddy from selling off assets to cover the default settlement. She also argued that due to the lapsed statute of limitations on the allegations, Diddy has a high chance of winning the case if it goes to trial.

The case will proceed, but it's likely that Diddy's legal team will file a motion to have the entire case dismissed. When the default settlement was thrown out, Cardello-Smith shouted, "This isn't over Mr. Fink! Let Mr. Combs know that. This is not over!"

In a statement, another attorney on Diddy's legal team said that Cardello-Smith's character should cast doubt on the legitimacy of his allegations.

"This man is a convicted felon and sexual predator who has been sentenced on 14 counts of sexual assault and kidnapping over the last 26 years," said attorney Marc Agnifilo. "His resume now includes committing a fraud on the court from prison, as Mr. Combs has never heard of him let alone been served with any lawsuit. Mr. Combs looks forward to having this judgment swiftly dismissed."

Earlier this month, Diddy was ordered to pay the $100 million default settlement after he failed to respond. He denied he was served the lawsuit and filed a motion to dismiss the judgment. Of course, Diddy has other issues right now because he's facing substantial time in prison on sex trafficking and racketeering charges.
